Common questions
What People Ask After A Car Wreck
What does a car accident lawyer cost?
We take car accident cases on a contingency fee, so there is no upfront fee or cost to you and no charge for the initial consultation. We are paid a percentage of the recovery, and if we do not recover money for you, you owe us no attorney fee. The specific percentage and how case costs are handled are set out in a written fee agreement that you read and sign before we represent you.
How much is my car accident case worth?
Honestly, nobody can tell you over the phone. It depends on the severity and permanence of your injuries, your medical expenses and lost income, how clear fault is, your own share of fault, and the single biggest limiter, how much insurance coverage actually exists. A claim worth a million dollars against a driver carrying only a minimum liability policy may only reach the available policies. We look at all of it before we give you a range.
How long do I have to file after a car wreck in Georgia?
Georgia sets a filing deadline, and it is shorter than most people expect. Miss it and the claim is over however strong it was. The date that applies depends on the kind of claim and on who you are claiming against, so call us and we will tell you yours. Evidence disappears long before any deadline runs, which is the other reason not to wait.
Do I have to use my own insurance first in Georgia?
It depends on the coverage you carry. Some policies pay medical bills early whatever the fault, and using that coverage is not an admission that the crash was your fault. We read every policy in play, yours and theirs, before anyone decides what gets filed where. Bring your declarations page to the first call if you can find it.
What if the crash was partly my fault?
Tell us anyway. Fault is rarely all on one side, and what the officer wrote at the scene is not the last word on it. What matters is how the evidence divides responsibility once someone actually works through it. That is worth a free conversation before you decide you have no claim.
What if the other driver had no insurance, or not enough?
We check that early, and it is more common than people expect. Coverage can come from your own policy, from another vehicle in your household, or from a company that owned or controlled the vehicle. Finding every policy that might pay is a large part of the work.
Should I accept the insurance company's first offer?
Talk to a lawyer first. An early offer often arrives before anyone knows whether your injury is permanent, and accepting it typically requires signing a release that ends your claim for good, including for treatment you have not had yet. There is no cost to having us look at the offer before you sign anything.
